Privacy Policy

1.  Introduction. Please read this Privacy Policy carefully.  This Privacy Policy explains what information Multimedia Games, Inc. and its wholly-owned subsidiaries (collectively, “MGAM”) collects when you visit our web site (this “Site”), the ways MGAM uses this information, your choices, and MGAM’s privacy practices.  This Privacy Policy only applies to information collected online by MGAM, its affiliates and any other affiliated company (unless specifically stated).

2.  Personally Identifying Information. The term “personally identifying information” (“PII”) means any information that may be used to identify a specific individual, including, but not limited to, a first and last name, a home or other physical address, an email address or other contact information, whether at work or at home. In general, you can visit this Site without telling us who you are or revealing any PII about yourself; provided, however, MGAM may collect PII when you provide it to us through an online registration form or at other times, such as if you apply for a job or choose to sign up for an e-mail newsletter or other update.  For example, we may collect your name, address, telephone number(s), and e-mail address when you provide us with that information, when you request information from us, when you access the Shareholder Tools, or contact us. We also may collect information about your job history and experience and your education when you submit your application for employment with MGAM or our affiliates on or through this Site. We also may ask you for other information to help us determine whether you would be eligible under various local immigration or employment laws to work in a particular country.

If you choose not to provide the PII that we may request, you can still visit MGAM’s web sites, but you may be unable to access certain options and services that involve our interaction with you.

We also may receive information about you from other sources, and we may combine the information that we receive from those other sources with PII that we collect online.  In those cases, we will apply this Privacy Policy to any PII received.

3.  Tracking Technologies. This Site or our e-mail messages may contain cookies, web beacons, or similar tracking technologies as they become available. A “cookie” is a small text file that may be used, for example, to collect information about web site activity. Some cookies and other technologies may serve to recall PII previously indicated by a site visitor. We may combine the tracking information we receive from cookies with PII that we collect through our web sites, but we will apply this Privacy Policy to this combined data.

A "web beacon” is a small graphic image that allows the party that set the web beacon to monitor and collect certain information about the viewer of the web page, web-based document or e-mail message, such as the type of browser requesting the web beacon, the IP address of the computer that the web beacon is sent to and the time the web beacon was viewed. Web beacons can be very small and invisible to the user, but, in general, any electronic image viewed as part of a web page or e-mail, including HTML based content, can act as a web beacon. MGAM may use web beacons to count visitors to the web pages on our web sites or to monitor how our users navigate those sites, and we may include web beacons or similar technologies in e-mail messages in order to count how many messages sent were actually opened or acted upon.

When you visit this Site, MGAM may collect automatically certain usage information, such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; “clickstream” patterns; and dates and times that this Site is accessed. We may associate your IP address with the PII you provide.

You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you may need to re-enter your user ID and password to gain access to certain parts of this Site.

4.  How MGAM Uses Information Collected. We may use the PII that we collect online to respond to your questions and information requests, and, if you specifically agree, to send you marketing and promotion materials.

We also may use information, including PII, to improve our marketing and promotional efforts, to statistically analyze usage of our web sites, and to improve the content and offerings on those sites. We also may use your PII to deliver content that is customized to your interests as we best understand them from the information that you have provided to us and from your activities on our web sites. In pursuit of these goals, we may combine non-PII collected through cookies and other tracking technologies with PII you have voluntarily submitted.

MGAM is not in the business of selling PII to others. MGAM does or may share or disclose information that you provide us to other companies and people with your consent or under the circumstances described below.  MGAM may analyze or disclose aggregated information that does not identify our users to third parties for marketing and promotional or other purposes.

We also may share user information with our subsidiaries, affiliates, business partners and service providers. These third parties may provide you information, products, or services on our behalf or to help us provide our customers with better products and services.

As we continue to develop our business, we might sell or buy assets. In such transactions, user information generally is one of the transferred business assets. Also, if all or substantially all the assets of MGAM or affiliates assets were acquired, user information would be one of the transferred assets. We do not offer for sale PII other than in connection with business-related transfers.

MGAM may transfer and disclose information about its web site users, including PII, and may use IP addresses to identify users in cooperation with internet service providers or law enforcement agencies, to comply with a legal obligation, at the request of governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing our web sites and applicable laws, or to protect the legal rights, interests, or safety of our web sites, our users or others.

Additionally, if all or substantially all the assets of MGAM or its affiliates are acquired, or if the company otherwise engages in a fundamental corporate change, PII collected by MGAM would be one of the transferred or disclosed assets.

5.  Employment Information. If you express an interest in employment with MGAM through one of our web sites, we will use your PII to evaluate your candidacy, and we may use your PII to contact you and others that you have identified on your application, including without limitation past employers, references and educational institutions, regarding your suitability. We may also collect information provided about, without limitation, your job history, experience, and education, when you submit a resume or application for employment to MGAM on or through one of our web sites. We also may ask you to submit information that will confirm your eligibility to work under relevant local immigration or employment laws.

6.  Updating Your Information and Choices. To unsubscribe from features you subscribed to from MGAM online, please email webmaster@mm-games.com.

Where we collect PII from you online, our goal is to provide you with a means of contacting MGAM, should you need to update or correct that Information. If, for any reason, those means are unavailable or inaccessible, you may send updates and corrections about your PII to webmaster@mm-games.com, and we will make reasonable efforts to incorporate the changes in your PII that we hold as soon.

7.  Other Sites and Third Parties. This policy only addresses the use and disclosure of information that MGAM collects on this Site. MGAM does not control and is not responsible for the privacy practices of other sites or third parties to whom you may link from this Site.  Once you link to another website you are subject to the privacy policy of that website.

8.  Children's Privacy. MGAM does not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information on a child under the age of 13, we will delete that data from our systems. MGAM encourages parents and guardians to go online with their children. Here are a few tips to help make a child's online experience safer:

  • Teach children never to give personal information (such as name, address, phone number, school, etc.), unless supervised by a parent or responsible adult.
  • Know the sites your children are visiting and which sites are appropriate.
  • Look for website privacy policies. Know how your child's information is treated.

9.  International Users. This Site is operated in the United States. If you are located outside of the United States, please be aware that any information that you provide to us will be transferred to the United States. By using this Site or providing us with your information online, you consent to this transfer.

10.  Acceptance and Privacy Policy Changes. By using this Site or by providing us with your information online, you accept our privacy practices, as outlined in this Privacy Policy. MGAM reserves the right to modify, alter or otherwise update this Privacy Policy at any time. We will post any new or revised policies on our web sites. Your continued use or access of the MGAM web sites after any such changes constitutes your acceptance of the new terms. If you do not agree to these or any future terms, do not use or access (or continue to use or access) this Site. It is your responsibility to regularly check the Privacy Policy to determine if there have been changes to these terms and to review such changes.
